DUI Education and Therapy

In addition to the offense outcome, penalties, and fines, the court may impose education, therapy or various combinations of both. Education and Therapy programs may be required by both the court and the Colorado Division of Motor Vehicles. Colorado has two levels of education and four levels of therapy. They differ in length, intensity and for whom they are intended.

Level I Education

Level I Education consists of 12 hours of DUI education over a minimum 3-day period not to exceed 4 hours in one calendar day conducted in a group setting. Level I Education is available for persons who have had one impaired driving offense and a low BAC between .05 and.079. You qualify for this service if you meet the following criteria:

• Priors: None
• BAC: Less than .10
• Program Length: 12 hours / 3-6 weeks

This is a 12-hour education program for people who have been convicted of driving while their blood alcohol level went beyond legal limits or while they were under the influence of a drug other than alcohol. It is for first time offenders who, when evaluated, showed no problems, other than impaired driving, associated with AOD use, who had no prior diagnosis of Substance Abuse or Substance Dependence, and no other problems related to AOD use or misuse. The main purpose is to help clients prevent driving while impaired by alcohol or other drugs.

Level II Education

Level II Education consists of 24 hours of DUI education over 12 weeks conducted in a group setting. Class size is limited to not more than 12 regularly attending group members. Level II Education may be recommended alone or may be followed by Level II Therapy depending upon previous offense and BAC. Level II Education is recommended for people on first offenses whose BAC is .149 or less.

Level II Therapy

Level II Therapy typically follows Level II Education and can range in length from 5 to 10 months or more depending on assessed clinical severity indicators. Therapy is conducted on an outpatient basis in weekly, two hour increments. Colorado has 4 levels of required Treatment Tracks along with Level II Therapy that consist of the following minimum hours and weeks: Track assignment depends on whether a person has prior impaired driving offenses, their BAC (or refusal to take a test) and other clinical indicators. These track recommendations are made by the alcohol evaluator (probation) or in the absence of an evaluation, the DUI licensed treatment agency.

Track A:

42 hours over 21 weeks, usually for a first time offender with a BAC below .15. Can also be required with BAC under .10 with clinical justification.

Track B:

52 hours over 26 weeks: No priors, BAC of .15 or above, or refusal. Can also be required with BAC under .15 with clinical justification.

Track C:

68 hours over 34 weeks: 68 hours / 34 weeks Therapy Treatment: Usually for someone with one or more priors, with BAC under .15.

Track D:

86 hours over 43 weeks: 86 hours / 43 weeks Therapy Treatment: One or more priors, BAC over .15, or refusal. Can also be required with BAC under .15 with clinical justification.
